To the Members of the State Legislature:
We, the undersigned, call on you to pass legislation known as "American Laws for American Courts" (ALAC).
There is a growing trend across America for judges to apply or countenance foreign law in cases such as family law.
This is problematic because there are instances where foreign laws do not provide constitutional protections to all parties in such cases.
A study of one type of foreign law found that over the past several years sharia law has been invoked in 146 different cases across 32 states and the federal courts.
ALAC is legislation that was designed to ensure constitutional protections for all parties to a case where foreign law may be considered. ALAC prohibits the application of any foreign law if doing so would conflict with the federal or state constitutions and/or infringe on the constitutional rights of any party to a case under consideration.
ALAC is now law in Alabama, Arizona, Florida, Kansas, Louisiana, Mississippi, North Carolina, Oklahoma, Tennessee, and South Dakota. In each state legislature it passed with strong bipartisan support. In Alabama, ALAC was passed as a constiutional amendmendment on the 2014 ballot.
ALAC is religiously neutral. Not a single court challenge has been filed against it, despite the fact that it has been in place in Louisiana and Tennessee since 2010.
For these reasons, we urge you to join the growing number of states that have passed ALAC by passing this legislation during this legislative session.
